These Terms govern access to and use of the EFT Marriage Counsellor Bot. They are a practical draft for this service and should be reviewed by a qualified lawyer before being treated as final legal advice. The operator of the service is Michael Fackerell.

1. Adults only

You must be at least 18 years old to use this service. By using it, you represent that you are 18 or older and legally able to accept these Terms.

2. Not therapy, medical care, or emergency support

This service is an AI support tool and is not a licensed therapist, doctor, lawyer, or emergency service. It does not provide medical advice, mental health diagnosis, crisis intervention, or legal advice. If you are in danger, experiencing abuse, self-harm risk, or another emergency, do not rely on this service.

3. Use at your own risk

AI-generated output may be incomplete, inaccurate, unhelpful, or inappropriate. You are responsible for deciding whether and how to use any response. You should use independent judgment before acting on the service's output.

4. Acceptable use

You agree not to use the service to:

  • violate any law or the rights of another person
  • harass, threaten, stalk, defame, or abuse others
  • upload malicious code or interfere with the security or operation of the service
  • impersonate another person or gain unauthorized access
  • use the service as a substitute for emergency, clinical, or legal services

5. Accounts and access

Access may be restricted by invitation, authentication, or administrator approval. We may suspend, revoke, or refuse access at any time, including for misuse, security concerns, or operational reasons.

6. Privacy

Your use of the service is also governed by the Privacy Policy.

7. Intellectual property

The service, including its software, design, prompts, and documentation, remains owned by its operator or licensors unless stated otherwise. You may use the service for its intended purpose only.

8. No warranties

To the maximum extent permitted by law, the service is provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied, including warranties of accuracy, availability, fitness for purpose, merchantability, and non-infringement.

9. Limitation of liability

To the maximum extent permitted by law, the operator will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, profits, relationships, goodwill, or opportunities arising from or related to your use of the service.

To the maximum extent permitted by law, the total liability of the operator for any claim relating to the service is limited to the amount you paid for the service in the 12 months before the claim, or AUD $100 if no fee was paid.

10. Indemnity

To the maximum extent permitted by law, you agree to indemnify and hold harmless the operator from and against any and all claims, demands, actions, proceedings, investigations, liabilities, judgments, settlements, penalties, fines, damages, losses, costs, and expenses of every kind, including reasonable legal fees and costs on a full indemnity basis, arising out of or related to your misuse of the service, your access to or use of the service, your content, your violation of these Terms, your violation of any law, regulation, or third-party right, or any allegation that your acts or omissions caused harm to another person.

This indemnity applies whether the claim is brought by another user, a third party, a regulator, or any government authority, and it includes claims connected with advice, reliance, communications, disputes, emotional distress, relationship outcomes, privacy breaches caused by you, misuse of exported transcripts, or any other downstream use or misuse of the service or its outputs by you or anyone who receives material from you.

To the maximum extent permitted by law, Michael Fackerell may assume the exclusive defense and control of any matter subject to indemnification by you, and you agree to cooperate fully with that defense at your own expense.

11. Termination

We may suspend or terminate the service or your access at any time. Provisions relating to liability, indemnity, intellectual property, privacy, and dispute handling survive termination.

12. Governing law

These Terms are governed by the laws of Queensland, Australia, unless mandatory law requires otherwise.
